Introduction

Welcome to the Membership Terms which will apply to you if you apply to become a Curzon member after 17 May 2021 (“Membership”) which you can use either in one of our Curzon cinemas or online via our platform Curzon Home Cinema, places to “open your eyes…to new worlds…and ways of seeing”, provided by us, Curzon Cinemas Limited (Reg No.00283280), 20-22 Stukeley Street, London, WC2B 5LR, UK (“Curzon”) in England only. 

Our Visiting Website and Making Online Purchases Terms apply to you when redeeming your Membership online. 

Our CHC Terms of Use will apply to you when using or redeeming your Membership benefits via Curzon Home Cinema (“CHC”).  

Our Visiting Our Cinemas Terms <insert link> will apply to you when using your Membership benefits in our Curzon cinemas. 

In applying to become a member, you accept these Terms as well as the terms listed above and agree to comply with all of them. They are subject to change from time to time, without prior written notice unless otherwise stated.  Please read them before making use of your Membership to understand your legal rights, remedies and obligations.

Who can become a member?
  1. Minimum age limit: our Membership scheme is reserved to those who are 18 years of age or older.  If you are aged between 16 and 18, please ask your guardian(s) to make purchases on your behalf; these Terms are for the attention of your parent(s) or guardian(s) who remain liable to us on your behalf for the use you make of your Membership.
  2. Our Membership scheme is subject to availability and reserved to those who live in the United Kingdom and can access our Curzon cinemas or can access our Curzon Home Cinema platform or apps (“CHC”) to redeem your Membership.   Please read the Terms of Use which will apply to use of CHC and provide you with essential information. The list of our Curzon cinemas is subject to changes from time to time at our discretion (e.g. temporary closure for refurbishment or permanent closure). All communication will be in the English language.
How to join?
  1. Type of Membership: please refer to our website Membership page to review the benefits of each type of Membership, the fee payable (if any), the duration and the payment options (e.g. one upfront payment or monthly payments).  

  2. Membership application: to become a member, please log into your Curzon account, you agree to apply by selecting “Membership”, reviewing the Membership Benefits and following the joining process.  If you don’t have a Curzon account yet, please sign up by providing your personal details either in our Cinema or online.  This creates an account for you and you will receive an email notification thanking you for the creation of your new Curzon account.  Please update the information in your account (in the Personal Details section) if your personal details have changed. Please refer to our Privacy Policy to find information about how we use your personal data.

  3. Membership package: please review the benefits of each Membership on our Membership sale page to select the one you would like to join.  Benefits that are not specifically listed in the package do NOT form part of it and are at our discretion.

  4. Membership Fee: save for the Under 25 Membership, the fee payable to become a member (“Membership Fee”) is as indicated during the joining process. You are responsible to settle the Membership Fee, failing this, we will suspend your Membership.  Any Membership Fee increase will be notified to you thirty (30) days in advance.

  5. Membership agreement: your application to become a Member is an offer to join our Membership scheme, our acceptance of your offer will create a contract between you and us (the “Membership Agreement”).  We will signify that the joining process is complete via email, if you join online (“Acceptance Email”).  You can enjoy your Membership immediately. 

  6. Payment methods: where one upfront payment is required, you can pay via debit or credit cards, digital wallet accounts that you hold, gift membership.  Where you can pay via monthly instalments, payments will be made using a credit or debit card payment with the first month paid on the day you joined and the recurring payments will be on the same day of the following eleven (11) months.  If any monthly card payment is rejected, we will invite you to log into your account to verify your card payment details or update them. After three failed attempts, your Membership will be frozen. Should this happen, please contact [email protected] for assistance.

  7. Minimum periods are  minimum consecutive periods of twelve (12) months, with the ability to terminate your Membership by sending notice at [email protected] with the subject line “termination” no less than thirty (30) days before the end of your current 12-month period.

  8. Other promotion: your Membership cannot be used in conjunction with other offers, promotions, cards or memberships, unless expressly permitted. 

  9. Personal to you: your Membership is for you only, unless we expressly allow you to share the benefits with your guest(s) or friend(s) (e.g. Classic or Cult+) but your presence is required at all times. You may not sell or make any commercial use of tickets or other benefits obtained using your Membership, and any attempt to do so will lead to suspension of your Membership.
Under 25 Membership
  1. Benefits: If you are under the age of 25 and meet the minimum age limit, you may become a member without paying any Membership Fee.  Our Under 25 Membership gives you access, always subject to availability, to: 
    1.  to benefit from discounts on cinema tickets (excluding events), food and beverage, on CHC to watch our curated content online; and,
    2. to receive preview and event invitations.

  2. Booking fees: Booking fees will continue to apply to online purchases.

  3. Changes: we reserve the right to alter or discontinue any benefits by giving you a thirty (30) day advance notice.
Classic Membership
  1. Benefits: our Classic Membership, gives you access, always subject to availability, to:
    1. five (5) credits over the duration of your Membership, each credit entitles you to either one cinema ticket or one streaming of the film of your choice on CHC, note that cinema tickets can be purchased for you and your guest(s);
    2. once you have used your Membership credits, discounts for you and one guest on cinema tickets, event tickets, food and beverage, on CHC to watch our curated content online; and,
    3. to receive preview and event invitations.

  2. No booking fees: when making online purchases, no booking fees will be charged.
  3. Membership support: a dedicated support live chat, email or telephone number is available to you to answer queries you may have, see details in 11.

  4. Changes: we reserve the right to alter or discontinue any benefits by giving you a thirty (30) day advance notice.
Cult Membership
  1. Benefits: our Cult Membership, gives you access to, always subject to availability:
    1. five (5) weekly credits, each Monday your account will be refreshed so you always have five (5) credits to enjoy per week, each credit entitles YOU to either one cinema ticket or one streaming of the film of your choice on CHC; note that you may not share your credits with a guest;
    2. priority booking;
    3. once you have used your Membership credits, discounts for you and one guest on cinema tickets, event tickets, food and beverage, on CHC to watch our curated content online; and,
    4. to receive preview and event invitations.

  2. Cult+ benefits: if you purchase the Cult+, the number of your weekly Membership credits is doubled, you will have ten (10) weekly credits, each Monday your account will be refreshed so you always have ten (10) credits per week; and, you will benefit from free event tickets. 

  3. Monthly payments: our Cult Membership can be paid via monthly instalments.  Payments will be made using a credit or debit card payment with the first month paid on the day you joined and the recurring payments will be on the same day of the following eleven (11) months. 
  4. No booking fees: when making online purchases, no booking fees will be charged.

  5. Membership support: a dedicated support live chat, email or telephone number is available to you to answer queries you may have, see details in 'Contacting us'.  

  6. Changes: we reserve the right to alter or discontinue any benefits by giving you a thirty (30) day advance notice.
Streaming on Curzon Home Cinema
  1. Membership credits: if your Membership gives you access to Membership credits, you are welcome to redeem them by streaming available content on CHC; the CHC Terms of Use will apply to you. Note that some recently released content may require an additional amount, if this is the case, it will be indicated when you select the content you would like to stream.

  2. Discounts: you will have access to discounted prices on CHC.

  3. Visit CHC: to use your credits or discount, please visit https://homecinema.curzon.com/, log in to your account, select the content you would like to watch, press ”Watch Now”, your available membership credit will appear for you to use then press “Redeem”; alternatively, the pricing displayed will already take into account your Membership discount, choose your preferred method of payment to proceed with the streaming of your selected content.
Membership e-card and ID
  1. Digital/e-card: when you log into your Curzon account, you will have access to an e-card showing your Membership ID and will be able to redeem your benefits.

  2. In our cinemas, please present your e-card (you may be able to save it in your e-wallet on your phone) and ID. We may request proof of your age, identity and/or residence to confirm compliance with these Terms or to conform to law, regulation, court order or similar public authority.

  3. Confidentiality:  You will agree to keep your username, password, Membership ID and/or the combination of them (each and together “Credentials”) confidential and secure; do not allow anyone else to use them, especially anyone under the age of 18 years old without your supervision. YOU ARE FULLY RESPONSIBLE AND LIABLE FOR ALL ACTIVITY CARRIED OUT UNDER YOUR MEMBERSHIP (WHETHER BY YOURSELF, BY SOMEONE UNDER YOUR CARE OR BY ANYONE WHO HAS BECOME AWARE OF YOUR CREDENTIALS THROUGH YOUR DELIBERATE ACT OR NEGLIGENCE). You will notify us immediately if you become aware of or suspect any unauthorised use of your Credentials.
Membership duration, increase and renewal
  1. Minimum duration: your Membership will last for recurring minimum duration of twelve (12) months unless you give us notice of your intention to terminate your membership before the end of your current 12-month minimum period. No refund will be given for Membership Fee for your minimum period, unless your membership terminates in one of the ways set out in these Terms and you are entitled to a refund. If you pay via gift membership or gift card, you haven’t made a payment to us for your membership, and you won’t be entitled to any refunds. 

  2. One Membership per minimum duration: You cannot cumulate two Memberships during the minimum duration. Your Membership is fixed; if you have chosen a Cult Membership, you cannot change it for a Classic Membership.  However, you may upgrade your Classic Membership to a Cult Membership by contacting us.

  3. if you paid with a one upfront payment, the Membership Fee payable for the subsequent 12-month minimum period will be payable upfront too; if you pay via monthly instalments, they will automatically carry on.  If you would like to terminate your Membership, you will have to send us a notice at [email protected]curzon.com with the subject line “termination”  before the end of your current 12-month period. If we do not receive your notice, your Membership will renew for another 12-month minimum period.

  4. Membership Fee Increase: If the membership fee for your package has increased, we will inform you thirty (30) before the start of your new 12-month minimum period with the Membership Fee.     
Termination, cancellation, discontinuation or suspension
  1. Your cancellation right (“cooling off right”): you may cancel your Membership if you joined online, at any time up to the expiry of 14 days after receipt of our Acceptance Email. We will refund the payment we received from you minus a reasonable amount proportionate to the use you made of your Membership prior to cancellation. Refunds will be made within 14 days using the same payment method. For clarity, if your Membership gives you access to 5 credits over the duration of the minimum period, which you use entirely via cinema tickets or CHC streaming before cancelling your Membership, the amount to be deducted will be equal to the Membership Fee and you will not be entitled to any refund. There is no cooling off right for Membership Fee paid by gift membership or gift cards.

  2. Termination at the end of your current 12-month minimum period: before the renewal of your Membership, we will notify you that if you wish to terminate your Membership, you have to give us notice at [email protected] with the subject line “termination” before the start of the new 12-month minimum period  so we can make the necessary arrangements (e.g. stop collecting the monthly instalments).

  3. Termination before the end of the current 12-month minimum period: during the minimum period, you may terminate your Membership but you will not be entitled to a refund unless we have seriously breached these Terms or your situation presents some exceptional circumstances, at our sole discretion.

  4. Our suspension, discontinuation or termination of your Membership: we reserve the right to suspend or terminate your Membership if, in our reasonable opinion:
    1. you breach these Terms (including failing to pay the Membership Fee), the  CHC Terms of Use, the  Visiting Website and Making Online Purchases Terms or the Visiting Our Cinemas Terms; your Membership will be terminated immediately on our notice of termination and you will not be entitled to any compensation or refund;
    2. you use your Membership fraudulently, abusively, unlawfully; you cause material behavioral issues or security concerns; your Membership will be terminated immediately on our notice of termination and you will not be entitled to any compensation or refund; 
    3. the Membership Fee was mispriced where the erroneous price was reasonably recognisable by you; in this situation we will terminate your Membership and refund the amounts we received from you; 
    4. we discontinue any or all of the memberships by giving you 30 days advance termination notice; in this situation, we will refund the Membership Fee paid in advance up to the date of the discontinuation by an amount pro rata to the remaining period of your Membership;
    5. we are required by law or by a local authority to close our cinema, we will suspend your Membership for temporary closure or we will terminate your membership for permanent closure ; you will not be entitled to any compensation or refund.

  5. Effects of termination: on the termination date, we will deactivate your Membership.  Any booking for a date posterior to the termination date will be cancelled automatically.
Important points
  1.  Limitation of Liability. If we fail to comply with these Terms, we are responsible for  loss or damage you suffer that is a foreseeable result of our breach of these Terms or our negligence, only. Loss or damage is foreseeable if it is an obvious consequence of our breach or if it was contemplated by you and us at the time of the Acceptance Email. To the extent permitted by law, we will not be liable to you or any third person for any indirect, consequential, exemplary, incidental, special or punitive damages, including for any lost profits or lost data arising from your order or use of your Membership, even if we were aware or has been advised of the possibility of such damages.  You agree not to use your Membership for any commercial, business or resale purposes, therefore we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.  Notwithstanding anything to the contrary contained herein, our liability to you will at all times be limited to the Membership paid by you up to a limit of £1,000 except in the event of death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by applicable law. If no amount is paid by you, you shall be limited to injunctive relief only unless otherwise permitted by law, and you shall not be entitled to damages of any kind from us, regardless of the cause of action.

  2. Indemnity. You agree to indemnify us for any loss or damage that we may incur, including without limitation legal fees, arising from your use of the Membership other than as permitted under these Terms.

  3. Events beyond our control. We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under any contract with you that is caused by any event, act, omission or circumstance beyond our reasonable control ("Force Majeure Event"). A Force Majeure Event includes any strike, lock-out or other industrial action, civil commotion, riot, invasion, terrorist attack or threat of terrorist attack, war (whether declared or not) or threat or preparation for war, fire, explosion, storm, flood, earthquake, subsidence, pandemic, epidemic or other natural disaster, impossibility of the use of railways, shipping, aircraft, motor transport or other means of public or private transport, impossibility of the use of public or private telecommunications networks (including the world wide web) and the acts, decrees, legislation, regulations or restrictions of any government). Our performance of any contract with you is deemed to be suspended for the period that the Force Majeure Event continues, we shall have an extension of time to perform our obligation so affected for a duration equal to that of the Force Majeure Events. If we are prevented from, or delayed in, performing of any contract with you by any Force Majeure Event for a continuous period of more than 30 days, either of us may terminate such contract with immediate effect on written notice, in which case neither of us shall have any liability to the other party (but without affecting any rights and remedies that arose before such termination).

  4. Severability. If any part, term, or provision of these Terms shall be held by a court of competent jurisdiction to be illegal, unenforceable, or in conflict with any relevant law, the remaining portions or provisions shall still remain valid and continue in full force and effect. 

  5.  Assignability. the Membership Agreement is binding on you and us and on our successors and assigns. You may not transfer, assign, charge or otherwise dispose of any contract with us (or any of your rights or obligations under it) without our prior written consent. We may freely assign, sub-license or otherwise dispose of any of your rights under these Terms.

  6. Third-party rights. These Terms are not intended to confer, and do not confer, any rights or remedies on any person other than you and us, except that any Curzon group company may enforce any right or remedy expressly conferred on such Curzon group company under these Terms. 

  7. Law and Jurisdiction. These Terms shall be governed by and will be construed in accordance with the laws of England and Wales. Any disputes arising under or in connection with these Terms shall be subject to the non-exclusive jurisdiction of the English Courts.
